(v) improve the music the Site generates;
(vi) identify visitors to the Site;
(vii) carry out research on our users' demographics and tracking of usage data; and
(viii) disclose to lawful authorities when required to do so by law.
We may also use information you provide to us for the purposes of contacting you with information regarding upcoming products, services, events or surveys. This shall only be done with your consent and our direct marketing policy which is explained in full below.
When you visit the Site, we may automatically collect additional information about you, such as the way you use the Site, the type of phone or operating system you use, the type of internet browser you use and the website from which you have come to the Site. Also, depending on whether you access the Site on your computer or via your mobile device, we may collect your IP address (the unique address which identifies your home computer on the internet) or the unique identifier (which is linked to your mobile device). 2.1 Jukedeck is a generative music site that creates and plays unique, responsive music.
3.1 Access to the Site is permitted at our discretion and we reserve the right to withdraw or amend the services we provide without notice. We won't be liable if, for any reason, the Site is unavailable at any time or for any period. From time to time, we may restrict access to some parts or the entirety of the Site.
3.2 We're not responsible for any arrangements or charges necessary for you to have access to the Site, any connection or access to the Site by you, or the quality of the transmission of any information passing between you and the Site.
3.3 If you use the Site from outside the United Kingdom, you're responsible for making sure you abide by all applicable local laws and regulations.
3.4 We can't guarantee that the Site will operate without bugs, viruses, errors or interruptions, or that their operation will be continuous. There may be times when certain parts of the Site become unavailable, with or without notice. We're not liable to you or any third party for any unavailability, modification, suspension or withdrawal of any part or the whole of the Site.
3.5 We might want to change the format and content of the Site, and we reserve the right to do this with or without notice. We also reserve the right to modify, change, substitute or withdraw any music generated by the Site and any other information on the Site. You agree that your use of the Site is on an 'as is' and 'as available' basis and at your sole risk.
4.1 We grant you a limited licence to use the Site to access and use our services for your own personal, non-commercial and commercial use, as long as you comply fully with these Terms.
5.1 You can’t sell or license music created by the Site to other people.
5.2 You can't try to gain access to the code that makes the Application work, and neither can you use this code or any insight gained from viewing this code for any commercial gain or in any way at all.
5.3 You can only use the Application and Site, and anything generated by or available from the Application or Site, for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that could damage our name or reputation.
5.4 All rights granted to you under these Terms will terminate immediately in the event that you breach these Terms.
6.1 By agreeing to these Terms, you accept that all music generated by the Site in any form (be it numerical data, audio data or otherwise) is the sole property of Jukedeck Ltd.
6.2 All intellectual property rights (which includes rights such as copyright, and rights in trade marks) in any content of the Site (including text, graphics, software, photographs, images, videos, sound, trade marks, logos, music and data describing music) are owned by us and/or our licensors. Except as expressly set out in these Terms, nothing in these Terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by downloading content from, or generating content using, the Site.
6.3 You agree that by submitting any posting for publication on the Site ("Your Content"), you retain any copyright you may have in Your Content, unless that content is music in any form (be it numerical data, audio data or otherwise) that was generated by the Site. However, you irrevocably and unconditionally grant us and our affiliates a perpetual, worldwide, non-exclusive, royalty-free and fully sub-licensable right and licence to use, reproduce, edit, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or in part) and/or to incorporate it into other works in any form, media or technology, whether for commercial or non-commercial purposes. You waive any moral rights you may have in, or to be identified as the author of, Your Content.
6.4 You are solely responsible for Your Content (including content you share with other sites) and we do not endorse Your Content or any opinion, recommendation, or advice expressed therein, and we expressly disclaim any and all liability in connection with Your Content.
6.5 By submitting Your Content, you represent, warrant and undertake to us that Your Content is not recorded or copied from any existing licensed sources, other than sources provided to you by Jukedeck, and that anything you upload (apart from music generated by the Site) is your own original work and you own the entire right, title and interest in and to the content and/or you have all necessary licenses, rights, consents and permissions to use, and to authorise us to use, and and all intellectual property rights in such content.
6.6 When you submit Your Content to the Site, it will be available publicly, which means that anyone will be able to see or listen to it. We can choose whether or not to include Your Content on the Site, and we can position Your Content on the Site as we see fit.
7.1 The Site may include links to external sites for various reasons, including to provide you with access to information and services that you may find useful or interesting. We are not responsible for the content of these sites or for anything provided by them and do not guarantee that they will be continuously available. The fact that we include links to such external sites does not imply any endorsement of or association with their operators.
7.2 You may link to our home page at www.jukedeck.com on the condition that you do so in a way that is fair and legal and does not damage our reputation or take advantage of it. You can't establish a link that suggests any form of association, approval or endorsement where none exists.
